Applications are invited for selection of Advocates as Panel Counsels for handling PMLA and FEMA cases before Ld. Appellate Tribunal, Ld. Adjudicating Authority and Ld. Special Director (Appeals), FEMA in Delhi and the places where the office of the Special Director (Appeals) is functional.
 
 

Details of eligibility criteria and other terms and conditions

Eligibility Criteria:

Qualification:
i. Essential: Bachelor’s Degree in Law from a National School or a recognized University or equivalent. The candidates are required to submit/attach the experience certificate issued by the Bar Association in support of the claim of the practice.
NOTE: Candidates having LLM degree may be given additional weightage. Further, applicants currently or previously empaneled with other Law Enforcement Agencies (LEAs) may also be given preference.

ii. Experience: He has been in practice as an advocate for not less than four years, under the Union or a State, requiring special knowledge of law as on 31/07/2025.

iii. Desirable: Having experience in handling matters related to criminal law and fiscal laws. Preference will also be given to those Advocates already, or previously, on the panel of other LEAs.

 
 
Nature of Duties:
  • To appear in the Ld. Appellate Tribunal/Ld. Adjudicating Authority and Ld. Special Director (Appeal), FEMA post allocation of handling PMLA/FEMA Cases by the Directorate,
  • To provide Legal Opinion regarding feasibility of filing an appeal in respect of the cases dealt by the respective counsel;
  • To keep updating the Directorate about the progress of the cases entrusted including detailed notes of proceeding via email so that the hearing may be ascertained as effective and non-effective hearing, and timely supply of copies of judgments/orders etc. iv To render all assistance to the Law Officers and Senior Advocates, if required to do so, who may be engaged in a particular case before the High Court(s) etc.;
  • The Panel Counsels shall also perform such other duties of legal nature like drafting of legal documents including Replies, Rejoinders, Written Synopsis which may be assigned to them by the Directorate;
  • To consult the concerned IO and Head of the concerned Unit before the next date of hearing of each case to ensure factual consistency, legal preparedness and alignment of strategy;
  • The counsel at one zone/sub-zone matter may be deployed for matters arising in another jurisdiction, especially in high stake or multi-jurisdictional cases;
  • The Empanelled Counsel so engaged will have the right of private practice, which should not, however, interfere with the efficient discharge of duties as counsel of the Directorate. He shall not advise, hold briefs or appear against the Directorate before the Courts/Tribunal or other authority, including the cases pertaining to the other LEAS where the investigation against the common accused or against any accused emerging out of the same FIR/ other equivalent report have initiated or even in other FIRs/ other equivalent report if, it is relating to the same/similar scam from the same jurisdiction or emerging out of other jurisdictions, in matters pertaining to Directorate of Enforcement.

Selection Process:

Only shortlisted candidates will be called for interview individually on their registered email id, which will be intimated through email only. No physical telephonic correspondence in this regard will be entertained by ED office. On completion of selection process, information shall be sent only to the selected candidates.
